Privacy Policy

This Privacy Policy explains how five, operated by Five Apply LLC (“we,” “us,” “our”), collects, uses, stores, and protects your personal information when you use our platform at fiveapply.work(the “Service”). We built our transparency page before our product. This privacy policy continues that commitment.

1. Information We Collect

Information You Provide

Account information (name, email via LinkedIn OAuth, profile details you choose to add), job posting content (titles, descriptions, requirements, company information), application content (pitches, High-Five selections, profile information), video and audio recordings (if you use the video pitch feature), and payment information (billing details collected and processed by Stripe — we do not store your credit card number, CVV, or full payment card details on our servers).

Information Collected Automatically

Usage data (pages viewed, features used, timestamps, interaction patterns), device information (browser type, operating system, device type), and IP address (used for security, fraud prevention, and approximate geographic location at the country/region level only).

Information Generated by the Service

If you record a video pitch, we use Deepgram to generate a text transcription. This transcription is displayed alongside your application for the Recruiter’s convenience and is never used for automated screening or hiring decisions. Key phrases may be extracted from transcriptions and displayed on your application. If you upload a resume, we extract skills information to provide relevance-based matching that helps surface roles aligned with your background. This matching is a convenience tool — it does not filter, hide, or remove any applications. Recruiters always see every applicant.

2. How We Use Your Information

We use your information to operate and provide the Service (hosting your profile, displaying job posts, delivering applications to Recruiters), process payments through Stripe, send transactional emails via Resend, detect and prevent fraud and automated abuse, respond to your support requests, and comply with legal obligations.

We do not use your information to:

Train AI or machine learning models · Sell to third parties, data brokers, or advertisers · Build advertising profiles · Generate, write, or auto-fill application content · Make hiring decisions or screen candidates · Target you with advertisements.

3. How We Share Your Information

With Other Users

Seekers: Your pitch and profile information are shared with the Recruiter who posted the role you applied to. Recruiters: Your job posting is visible to all Seekers on the platform.

Each provider processes data only as necessary to provide their service and under their own privacy policies and data processing agreements.

For Legal Reasons

We may disclose your information if required by law, legal process, or government request, or to protect the rights, property, or safety of five, our users, or the public.

4. Data Retention

Active accounts: We retain your data for as long as your account is active. Video recordings are stored on Cloudflare R2 and applicant videos are retained for the active duration of the associated job posting (up to 60 days) unless deleted earlier by the user. When you delete your account, we delete your personal data including profile information, pitches, and video recordings. We may retain anonymized, aggregated data that cannot identify you. We retain financial transaction records as required by tax and accounting law. Account deletion is processed within 30 days of your request.

5. Your Rights

All Users

You may request access to a copy of the personal data we hold about you, request deletion of your personal data, request correction of inaccurate personal data, and request your data in a machine-readable format (portability).

California Residents (CCPA/CPRA)

Right to know what personal information is collected, used, and shared. Right to delete personal information. Right to opt out of the sale of personal information — we do not sell your personal information. Right to non-discrimination for exercising your privacy rights.

European Economic Area Residents (GDPR)

All rights listed above, plus the right to restrict processing and the right to object to processing. Our legal basis for processing your data is: (a) performance of our contract with you (providing the Service), (b) legitimate interests (security, fraud prevention), and (c) your consent (video recording).

To exercise any of these rights, email privacy@fiveapply.work. We will respond within 30 days.

6. Video Recording and Consent

Video pitches are an optional feature. If you choose to record a video, you will see a clear consent prompt before recording begins. Recording does not start until you take affirmative action. Your video is uploaded to Cloudflare R2 and transcribed by Deepgram. The transcription is used for display purposes only — it is shown alongside your application for the Recruiter to read. It is never used for automated screening, ranking, or filtering. You can delete your video at any time by deleting the associated application or your account.

If you are in a two-party consent jurisdiction (including California, Florida, Illinois, Washington, Pennsylvania, and others), the in-app consent prompt satisfies the requirement for your informed, affirmative consent to be recorded.

7. Cookies and Tracking

We use essential cookies only — those required for authentication, session management, and security. We do not use advertising cookies, tracking pixels, third-party analytics that track you across websites, or social media tracking scripts.

8. Children’s Privacy

five is not intended for anyone under 18 years of age. We do not knowingly collect personal information from children. If you believe a child has created an account, contact us at privacy@fiveapply.work and we will promptly delete it.

9. Security

We implement reasonable technical and organizational measures to protect your data, including encryption in transit (TLS/HTTPS), row-level security on our database (Supabase RLS), secure authentication via OAuth providers, and access controls limited to essential personnel. No system is perfectly secure. If we become aware of a data breach affecting your personal information, we will notify you and applicable authorities as required by law.

10. International Data Transfers

Our servers and service providers are located in the United States. If you access the Service from outside the U.S., your data will be transferred to and processed in the U.S. By using the Service, you consent to this transfer.

11. Changes to This Policy

If we make material changes to this Privacy Policy, we will notify you via email or through the Service at least 30 days before the changes take effect. We will always post the current version at fiveapply.work/privacy.

13. CAN-SPAM Compliance

All emails sent by five include a clear identification of five as the sender, a valid physical mailing address, and a working unsubscribe mechanism. We honor unsubscribe requests within 10 business days.
